PLEASE NOTE: All Bidders and others attending this auction live agree that they have read and fully understand these terms and agree to be bound thereby.

1. IDENTIFICATION: Bidders are required to obtain a bidding number from the cashier and give full name, address, phone number and driver's license info or acceptable government issued identification substitute.
2. BUYER PREMIUM: A Buyer Premium of 10% is added to the high bid for all in-person purchases and 15% for all online purchases (if online bidding is offered). Please take this into consideration when bidding. Bid price + buyer premium = final contract price.
3. BIDDER RESPONSIBILITY: Bidders who register to participate both in-person and online ("dual registration"; if online bidding is available) are solely responsible for monitoring any maximum bids they have placed through the third-party online bidding platform. SHERIDANS disclaims any responsibility or liability if, during the course of the auction, a bidder's live (in-person) bidding competes with or exceeds a maximum bid the same bidder has previously submitted online. It is the sole responsibility of the bidder to track their own activity across all platforms.
4. PAYMENT: To be made during or immediately following close of auction sale in cash, check, wire transfer (for wire transfers add $45; instructions available upon request), or MC/VISA with full identification. A 4% buyer surcharge is applicable on all credit card purchases. Any returned checks will be turned over to the proper authorities for collection if not resolved in a reasonable timeframe. A $45 dollar "bounced check" fee will be charged to the purchaser in the case of a returned check.
5. SALES TAX: All purchases will be subject to a 6.75% (Greene County, Ohio) sales tax on the final contract price when applicable according to Ohio Rev. Code (ORC) Chapter 5739 unless Purchaser presents a valid vendor number and signs a sales tax exemption form prior to payment. SHERIDANS will not collect sales tax for the purchases of coins and precious metals or titled vehicles which may include but not be limited to automobiles, trailers, and boats. Sales tax for the titled vehicles will be paid to the state when the title is transferred.
6. REMOVAL: No property may be removed from auction site until fully paid for. Payment and removal must be performed the day of the auction.
7. DISPUTED BIDS: In a live-call auction, the final bidder will be deemed to be the bidder recognized by the auctioneer accepting bids. In the event of a disputed bid, the decision of the auctioneer accepting bids will be final.
8. INSPECTIONS: Public Inspection Wednesday, May 20, 10:00 AM through 3:00 PM and date of auction (May 21), 8:00 AM through 10:00 AM.
9. RESPONSIBILITY: Once property is pronounced sold by the auctioneer, the responsibility for the safety of the property passes to the buyer.
10. AGENCY: The Auctioneers are acting as agents of the Principal only. The Auctioneers are not responsible for acts of or statements by the Principal.
11. RECORDS: The record of auction sale kept by the clerk will be taken as final in the event of a dispute. This auction may be recorded by audio and/or video tape, photography, and any other media format for record, advertising, and other purposes.
12. FUTURE COMMUNICATIONS & COMPANY MARKETING: By registering to bid at this auction, you agree to receive emails regarding upcoming auctions and events hosted by SHERIDANS. You may opt out of these communications at any time by clicking the unsubscribe button. SHERIDANS may also use photographic images (still or video) of an event you attend and utilize such images in marketing materials. Your contact information will be stored securely and not sold to third parties.
13. CONDITION OF PROPERTY SOLD: The Auctioneers shall not be held responsible for condition of property sold as all property is exposed to public examination and sold "as is" without recourse unless otherwise stated.
14. GUN PURCHASES: A firearm purchaser must be over the age of 21 for handguns or 18 for long guns, a resident of the state of Ohio, and not a convicted felon. All firearms will be sold pursuant to Title 27, Chapter II, of the Code of Federal Regulations (CFR). Background checks will be performed.
15. TITLED VEHICLE PURCHASES: If a titled vehicle is purchased, the title to the vehicle, trailer, or other titled vehicle will be mailed via the United States Postal Service (USPS) to the purchaser 15 business days after the auction unless otherwise announced. In the case of probate or other court-related proceedings, the title will not be mailed until the court's approval is obtained. SHERIDANS assumes no liability for these titles after they are placed in the possession of the USPS. Ohio trailer title laws do not require a title for trailers weighing less than 4,000 lbs, and no title will be available in such instances unless otherwise noted.
16. MODIFICATIONS, TECHNICAL DIFFICULTIES & OTHER: SHERIDANS shall not be held liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, internet outages, equipment failures, or governmental actions.
16.1: SHERIDANS retains full discretion to modify the date, time, order, and details of the auction for any reason or no reason at all, including but not limited to technical issues, emergencies, and convenience of SHERIDANS or the Seller.
17. DISCLAIMERS: All items sold AS IS, WHERE IS with all faults and without warranty expressed or implied.
18. ANNOUNCEMENTS: Announcements made at the time of the auction take precedence over any previous statements, written or otherwise.
19. BIDDER TERMINATION: SHERIDANS reserves the right to terminate or suspend any bidder's account or deny participation at any time for any reason deemed appropriate, including suspicion of fraudulent activity, nonpayment at past SHERIDANS' or other auctioneer's auctions, or other violation of auction terms.
20. LIMITATION OF LIABILITY: Under no circumstances shall SHERIDANS be liable for incidental, consequential, or punitive damages arising out of participation in this auction, even if advised of the possibility of such damages.
