Bidding Procedure: The properties will sell to the highest bidder(s) via Public Auction using the Multi-Parcel Auction Method. The properties will sell subject to confirmation of the Seller.
Acceptance of Bid Prices: Successful bidder(s) will sign a Confirmation of Sale Agreement at the auction site immediately following the close of bidding. Successful online bidder(s) will sign a Confirmation of Sale Agreement within 24 hours after Auction. Bidding IS NOT CONDITIONAL UPON FINANCING.
Down Payment: Purchaser(s) will deposit $20,000 per tract ($30,000 if purchasing both tracts) as down payment with the Auction Company upon signing of Confirmation of Sale Agreement. Onsite Purchaser(s) will place deposit date of auction; online Purchaser(s) will place deposit within 48 hours of auction’s end. Balance will be due at closing.
Real Estate Taxes: No 2023 property tax proration will be recognized at closing (see below for Cash Rent discussion). All 2022 property taxes (payable in 2023) will be credited to Purchaser(s). Purchaser(s) will be responsible for any Current Agricultural Use Valuation (CAUV) recoupment fees due to a change in land use initiated by Purchaser(s).
Closing Date: May 26, 2023, time being of the essence.
Possession: Date of closing, subject to tenant's in possesision right to havest 2023 grain crop.
Cash Rent: All 2023 cash rents ($15,261 annual) will be paid by tenant farmer to new owner(s) (Tract 1 - $9,673 and Tract 2 - $5,588) as follows: (1) first half will be paid following closing; (2) second half will be paid following harvest.
