Auction is being conducted at the Cedar Land Event Center, 200 Parkview Ln, Cedarville, OH.
Terms
Bidding Procedure: The property will sell to the highest bidder(s) via Public Auction using the Multi-Parcel Auction Method – bid on either or both tracts. The property will sell subject to confirmation of the Seller.
Acceptance of Bid Prices: Successful bidder(s) will sign a Confirmation of Sale Agreement at the auction site immediately following the close of bidding. Successful online bidder(s) will sign a Confirmation of Sale Agreement within 24 hours after Auction. Bidding IS NOT CONDITIONAL UPON FINANCING.
Down Payment: Buyer(s) will deposit the $25,000 per tract as down payment with the Auction Company upon signing of Confirmation of Sale Agreement. Onsite Buyer(s) will place deposit date of auction; online Buyer(s) will place deposit within 48 hours of auction’s end. Balance will be due at closing.
Real Estate Taxes: Taxes will be prorated to the date of closing (long proration method). Buyer(s) will pay for any Current Agricultural Use Valuation recoupment fees due to a change in land use.
Closing Date: May 17, 2024, time being of the essence.
Possession: Date of closing. Buyer(s) may take immediate possession of the tillable land following the auction for the sole purpose of planting the 2024 cash grain crop (restricted to corn and soybeans) by depositing an additional amount equal to one-half of the required contractual down payment with Broker at time of signing the Purchase Contract. By taking possession of property for this purpose, buyer(s) will agree that if they do not close on the transaction(s) according to the terms of this contract, they will forfeit (1) all of the deposited earnest monies, (2) the additional early possession deposit; (3) any inputs (fertilizer, seed, etc) placed into the property during this interim possession period; (4) the rights to cultivate and harvest the 2024 cash crops; and (5) the right to file a mechanic’s lien related to the forfeiture of the above funds and rights.
Tract Survey: Both parent parcels will have lot splits excepted from them prior to transfer at Seller’s expense. If lot splits are not completed and approved by all required Greene County departments by contracted date of closing, Buyer will agree to extend the contract up to 90 days until survey can be completed.
Agency: SHERIDANS LLC and its representatives are Exclusive Sales Agents for the Seller.
Online Bidding: Auctioneer will accept online bids during auction in real time. Auctioneer retains full discretion to modify these terms at any time prior to or during the auction. Bidders’ use of online bidding option and bid placement constitutes acceptance and agreement to adhere to these terms. All bidders are responsible for reading all terms and conditions.
