REAL ESTATE SALE TERMS
Bidding Procedure: The property will sell to the highest bidder, subject to confirmation of the Seller.
Acceptance of Bid Prices: The successful bidder will sign a Confirmation of Sale Agreement at the auction site immediately following the close of bidding. Bidding IS NOT CONDITIONAL UPON FINANCING.
Downpayment: $20,000 as down payment will be deposited with the Auction Company on the date of auction upon signing of Confirmation of Sale Agreement; balance due at closing.
Real Estate Taxes: Taxes will be prorated to date of closing using long proration method. Purchaser will be responsible for CAUV recoupment due to change in land use, if applicable.
Survey and Adjustments: Seller to provide new boundary survey subsequent to the auction but prior to closing. The two current parcels to be re-surveyed into one parcel. If new survey results in more acreage than indicated in Purchase Contract, then no price adjustment will be made. If new survey results in less acreage than indicated in Purchase Contract, then the purchase price will only be adjusted down if total acreage decreases by more than 1 acre (<67.076 acres). If new survey results in acreage decreasing by less than 1 acre, then no price adjustment will be made.
Closing Date: On or before December 28, 2015. Seller and Purchaser mutually agree to extend the contracted closing date up to 30 days if new survey is not completed by December 28, 2015. Purchaser will pay customary portion of closing costs at closing.
