PLEASE NOTE: Your use of this site and bid placement constitutes your acceptance and agreement to adhere to these terms. Please print a copy for your records.
These Terms & Conditions constitute a legally binding contract between SHERIDANS and each registered bidder. By using the bidding platform or placing a bid, you affirm that you have read and accepted these Terms in full. Ignorance of these terms will not excuse non-performance or non-compliance.
All disputes arising under or related to these terms shall be governed by the laws of the State of Ohio, and venue for any legal action shall lie exclusively in the courts located in Greene County, Ohio.
1. IDENTIFICATION & REGISTRATION: Online Bidders are required to obtain a bidding number from the third party bidding platform and give full name, address, valid phone number, valid email address, and valid credit card information.

1.1: The bidding platform may verify your credit card information by placing a hold (usually $1) on the card with which you register. This hold is temporary and should be released within a reasonable timeframe. Bidders must maintain current and accurate contact/payment information during the duration of the auction and through the scheduled load-out period.
1.2: Upon successful online registration, the third-party bidding platform will automatically approve online bidders to place bids of up to $100,000 USD per lot. SHERIDANS, at its sole discretion, may manually increase (or decrease) this bidding limit for individual bidders at any time prior to the start of the auction or during the auction as necessary. Online bidders who register after the auction has begun are not guaranteed to receive manual approval before the sale of any lots in which they are interested. SHERIDANS strongly encourages early registration to ensure adequate time for review and approval. SHERIDANS shall not be held liable for any missed bidding opportunities resulting from delayed registration or pending approval.
2. BUYER PREMIUM: A Buyer Premium of 10% is added to the high bid for all online purchases. Please take this into consideration when bidding. Bid price + buyer premium = final contract price.
3. BIDDER RESPONSIBILITY: Bidders are solely responsible for monitoring the lots in which they intend to place bids.
3.1: The bidding platform may notify bidders via email if they are no longer the high bidder; however, SHERIDANS makes no guarantee regarding the timeliness, accuracy, or delivery of such notifications. Maximum (or “max”) bids are permitted during this auction. In the event two online bidders place identical max bids, the bidding platform will recognize the bid submitted first as the prevailing bid. Accordingly, priority shall be given to the earliest timestamped bid in any tie scenario. In cases where an online max bid competes with a live in-person bid, the auctioneer accepting bids retains discretion and may, in accordance with standard auction practice, award the high bid to the in-person bidder. For additional information regarding bid disputes and auctioneer discretion, please refer to Section 7.

4. PAYMENT: By registering and placing a bid, the bidder expressly authorizes SHERIDANS to charge the credit card on file in accordance with these terms, including for any unpaid balances, damages, or losses resulting from default.
4.1: Payment is to be made before or during the scheduled load-out date and prior to removal of any items. All payments will be made in U.S. funds and acceptable forms of payment include cash, check, wire transfer (for wire transfers add $45; instructions available upon request), or MC/VISA with full identification. A 4% buyer surcharge is applicable on all credit card purchases. Driver’s license or acceptable government issued substitute must be presented prior to payment and load-out as requested by the SHERIDANS staff. Any returned checks will be turned over to the proper authorities for collection if not resolved in a reasonable timeframe. A $45 dollar “bounced check” fee will be charged to the purchaser in the case of a returned check.
4.2: The credit card on file with the third-party bidding platform will not be automatically charged at the close of the auction and will only be charged upon the express authorization of the purchaser or in the event that the purchaser fails to pay for their items by other means before the end of the scheduled load-out timeframe, as defined in the auction terms or communicated by SHERIDANS. Credit Cards may not be accepted for invoices over $5,000 at SHERIDANS' sole discretion.
4.3: In the case of nonpayment or insufficient payment to satisfy the full invoice, the successful bidder will be deemed in default, flagged in SHERIDANS ' internal database, and may forfeit any rights to the purchased items. SHERIDANS reserves the right, at its sole discretion, to sell the item(s) to the next highest qualified bidder if the original high bidder fails to comply with the auction terms. By registering for and placing a bid, the bidder expressly agrees to all terms and conditions of the auction, including authorization for SHERIDANS to charge the credit card on file for the full balance due plus any and all costs incurred by the Seller and SHERIDANS in a subsequent resale of the item(s), including, but not limited to, administrative fees, attorney’s fees, storage, collection costs, and any other related expenses. Should the item(s) be resold at a price lower than the original high bid, the defaulting bidder further expressly agrees to allow SHERIDANS to charge their credit card for the difference between their high bid and the final resale price.
4.4: All sales are final – no refunds.
5. SALES TAX: Sales tax will not be collected for this auction according to Ohio Rev. Code (ORC) Chapter 5739. SHERIDANS will not collect sales tax for the purchases of coins and precious metals or titled vehicles which may include but not be limited to automobiles, trailers, and boats. Sales tax for the titled vehicles will be paid to the state when the title is transferred.
6. REMOVAL & SHIPPING: No property may be removed from auction location until fully paid for. Payment and removal must be performed on the scheduled load-out date noted at the end of this section. SHERIDANS will not be responsible for loss, theft, or damage of purchased items. Items not picked up by the end of the designated load-out timeframe may, at SHERIDANS’ discretion, be considered abandoned and forfeited without refund. SHERIDANS reserves the right to charge a daily storage fee of $5 per lot for any lots remaining beyond the stated pickup period.
The load-out date is as follows: Friday, August 29 between 9AM and 3PM.

7. DISPUTED BIDS: In a live-call simulcast auction, the final bidder will be deemed to be the bidder recognized by the auctioneer accepting bids. In the case of a tie bid with both an in-person and an online bidder (even if the online bidder has posted a maximum bid the same as the in-person bidder), it is possible that the auctioneer will recognize the floor bidder as the winning bidder over the online maximum bid. In the event of a disputed bid, the decision of the auctioneer accepting bids will be final.
8. INSPECTIONS: Public Inspection Monday, August 25, 9:00 AM through 1:00 PM.
8.1: SHERIDANS may, at its sole discretion, facilitate virtual audio or video inspections of auction items upon bidder request during this public inspection. These virtual inspections are offered solely as a courtesy and are not intended to replace an in-person inspection. Due to the inherent limitations of video technology—including but not limited to lighting, resolution, camera angle, environmental conditions, and limited physical access—video inspections may not accurately capture all material defects, wear, or operational characteristics of the items offered for sale.
By requesting or relying upon a video inspection, the bidder acknowledges and agrees that such inspection is limited in nature and assumes all risk related to their purchasing decision. The bidder hereby waives any and all claims against SHERIDANS, its agents, employees, or representatives, and agrees to hold SHERIDANS harmless for any inaccuracies, omissions, or undiscovered defects that may result from or be attributable to a virtual inspection.
9. RESPONSIBILITY: Once property is pronounced sold by the auctioneer, the responsibility for the safety of the property passes to the buyer. SHERIDANS will make reasonable efforts to safeguard purchased lots until the close of the designated load-out period. However, SHERIDANS shall not be held responsible for loss, theft, damage, or deterioration of any item(s) left unclaimed beyond the scheduled pick-up date. After this date, all risk of loss shall pass to the buyer, and SHERIDANS assumes no further obligation to store, secure, or protect the item(s)
10. AGENCY: The Auctioneers are acting as agents of the Principal only. The Auctioneers are not responsible for acts of or statements by the Principal.
11. RECORDS: The record of auction sale kept by the clerk will be taken as final in the event of a dispute. This auction may be recorded by audio and/or video tape, photography, and any other media format for record, advertising, and other purposes.
12. FUTURE COMMUNICATIONS & COMPANY MARKETING: By registering to bid at this auction, you agree to receive emails regarding upcoming auctions and events hosted by SHERIDANS. You may opt out of these communications at any time by clicking the unsubscribe button. SHERIDANS may also use photographic images (still or video) of an event you attend and utilize such images in marketing materials. Your contact information will be stored securely and not sold to third parties.
13. CONDITION OF PROPERTY SOLD: The Auctioneers shall not be held responsible for condition of property sold as all property is exposed to public examination and sold “as is” without recourse unless otherwise stated.
14. GUN PURCHASES: A firearm purchaser must be over the age of 21 for handguns or 18 for long guns, a resident of the state of Ohio, and not a convicted felon.
15. TITLED VEHICLE PURCHASES: If a titled vehicle is purchased, the title to the vehicle, trailer, or other titled vehicle will be mailed via the United States Postal Service (USPS) to the purchaser 15 business days after the auction unless otherwise announced. In the case of probate or other court-related proceedings, the title will not be mailed until the court’s approval is obtained. SHERIDANS assumes no liability for these titles after they are placed in the possession of the USPS. Ohio trailer title laws do not require a title for trailers weighing less than 4,000 lbs, and no title will be available in such instances unless otherwise noted.
16. MODIFICATIONS, TECHNICAL DIFFICULTIES & OTHER: SHERIDANS shall not be held liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, internet outages, equipment failures, or governmental actions.
16.1: SHERIDANS retains full discretion to modify the date, time, order, and details of the auction for any reason or no reason at all, including but not limited to technical issues, emergencies, and convenience of SHERIDANS or the Seller.
16.2: In the event that there are technical difficulties related to the server, software or any other online auction-related technologies, SHERIDANS and the Seller reserve the right to extend bidding, continue the bidding, or close the bidding. Neither the bidding platform nor SHERIDANS nor the Seller shall be held responsible for a missed bid or the failure of the software to function properly for any reason. Email notifications may be sent to registered bidders with updated information as deemed necessary.
17. DISCLAIMERS: All items sold AS IS, WHERE IS with all faults and without warranty expressed or implied. SHERIDANS is not responsible for any missing or incorrect listing information. We have attempted to provide accurate descriptions; however, it is the bidder's responsibility to execute due diligence by inspecting the items, asking questions, and/or conducting any video or photographic inspections to determine the condition of each item. Descriptions that are provided by the Auction Company are provided in good faith and may be matters of opinion. It is automatically acknowledged by registering that you have inspected the items being sold to your satisfaction. By placing a bid, this creates a contractual agreement to purchase the items being sold at the final contract price plus additional fees as described in these terms and conditions.
18. ANNOUNCEMENTS: Announcements made at the time of the auction take precedence over any previous statements, written or otherwise.
19. BIDDER TERMINATION: SHERIDANS reserves the right to terminate or suspend any bidder’s account or deny participation at any time for any reason deemed appropriate, including suspicion of fraudulent activity, nonpayment at past SHERIDANS’ or other auctioneer’s auctions, or other violation of auction terms.
20. LIMITATION OF LIABILITY: Under no circumstances shall SHERIDANS be liable for incidental, consequential, or punitive damages arising out of participation in this auction, even if advised of the possibility of such damages.
