Real Estate Sale Terms

Bidding Procedure:  The property will sell by the Multi-Parcel Auction Method to the highest bidder(s).  Prospective buyers can bid on individual tracts, combinations of tracts, or the entire property.  Bidding and bidding increments on each of the tracts and combinations thereof during the auction will be determined by the Auctioneer.  The property will sell in the manner resulting in the highest total bid price(s), subject to the confirmation of the Seller.

Acceptance of Bid Prices:  The successful bidder(s) will sign a Confirmation of Sale Agreement at the auction site immediately following the close of bidding.  Purchaser to be responsible for normal & customary purchaser closing costs.

Down Payment:  Five percent (5%) of final bid price(s) as down payment day of auction upon signing of Confirmation of Sale Agreement; balance due at closing.  Bidding IS NOT CONDITIONAL UPON FINANCING.

Real Estate Taxes:  Taxes will be prorated to date of closing based on the Greene County Auditor's 2006 taxes.  Purchaser to be responsible for any CAUV recoupment charges due to change in land use (see Bidder Package).

Closing Date:  On or before December 31, 2007.

Zoning:  All tracts are currently zoned for Agricultural use which, subject to zoning requirements, permits one single-family dwelling per parcel.  Road frontage on Tract 3 is less than Cedarville Township's minimum zoning requirements for residential building purposes.  For questions regarding zoning and building permits, contact Cedarville Township Zoning Inspector.

Possession:  Date of closing, with tenant's rights reserved to harvest 2007 crops, if any.
