Real Estate Sale Terms

Bidding Procedure:  The property will sell by the Multi Parcel Auction Method to the highest bidder(s).  Bidding on each of the tracts and combinations thereof during the auction will be determined by the Auctioneer.  The property will sell in the manner resulting in the highest total bid price(s), subject to the confirmation of the Seller.

Acceptance of Bid Prices:  The successful bidder(s) will sign a Confirmation of Sale Agreement at the auction site immediately following the close of bidding.  Purchaser(s) to be responsible for normal & customary purchaser closing costs.

Down Payment:  Ten percent (10%) of final bid price(s) as down payment day of auction upon signing of Confirmation of Sale Agreement; balance due at closing.  Bidding IS NOT CONDITIONAL UPON FINANCING.

Real Estate Taxes:  Taxes will be prorated to date of closing according to property tax splits prepared by Clark County Auditor's Office.   Purchaser to be responsible for any CAUV recoupment charges due to change in land use (see Bidder Package).

Closing Date:  On or before March 9, 2007. 

Possession:  Date of closing.

Survey:  The Seller will provide a new survey to the Purchaser(s).  All lot splits are zoned for agricultural use (i.e. single family dwellings and agricultural uses allowed).  All lot splits and terms of sale are contingent on approval by all pertinent township and county governmental offices.

Grain Facility Bidding and Removal:  Tract 4 (grain facilities) will be offered as a separate tract and may be combined with Tract 2 or any combination of tracts containing Tract 2.  If Tract 4 receives no bids, it will be considered to be a part of Tract 2 and title will pass to the Purchaser of Tract 2 at closing.  If Tract 4 sells individually to a Purchaser who does not also purchase Tract 2, Purchaser of Tract 4 will remove the grain bins and all related equipment at his/her expense on or before May 1, 2007.  Upon failure by Purchaser of Tract 4 to comply on or before May 1, 2007, with the terms of the Auction as stated above, Purchaser of Tract 2 will automatically assume ownership of the grain facilities.
