Real Estate Sale Terms

Bidding Procedure:  The property will sell by the Multi-Parcel Auction Method to the highest bidder(s). Bidding on each of the tracts and combinations thereof during the auction will be determined by the Auctioneer. The property will sell in the manner resulting in the highest total bid price(s), subject to the confirmation of the Seller.

Acceptance of Bid Prices:  The successful bidder(s) will sign a Confirmation of Sale Agreement at the auction site immediately following the close of bidding. Purchaser to be responsible for normal & customary purchaser closing costs.

Down Payment: Ten percent (10%) of final bid price(s) as down payment day of auction upon signing of Confirmation of Sale Agreement; balance due at closing.  Bidding IS NOT CONDITIONAL UPON FINANCING.

Real Estate Taxes:  Taxes will be prorated to date of closing according to property tax splits prepared by Clark County Auditor’s Office.  Purchaser to be responsible for any CAUV recoupment charges due to change in land use (see Bidder Package).

Closing Date:  On or before March 10, 2006. 

Possession:  Date of closing.

Survey:  The Seller will provide a new survey to the Purchaser(s). All lot splits and terms of sale are contingent on approval by the Clark County Planning Commission, Clark County Combined Health District, and all other pertinent local and county governmental offices.

Natural Gas Line Easement: Gas line (Columbia Gas) easement exists on Tracts 1, 2, 3, 4, 6 and 7. Restrictions exist for use of the property within this easement.
